Power Disc Golf Academy by TRDVSC, LLC (the “School”)

1. Terms

By accessing this School, you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.

2. Use License

  1. Permission is granted to temporarily download one copy of any downloadable materials on the School’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
  2. modify or copy the materials;
  3. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  4. attempt to decompile or reverse engineer any software contained on the School’s web site;
  5. remove any copyright or other proprietary notations from the materials; or
  6. transfer the materials to another person or 'mirror' the materials on any other server.
  7. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

The materials on the School’s website are provided 'as is'. The School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Release and Assumption of Risk [READ CAREFULLY]

You understand that the materials provided by the School are designed to provide instruction on how to play the game of disc golf. The materials are designed to teach techniques and strategies to use while playing the game of disc golf. However, you also understand that any physical activity, including disc golf, carries potential risk. The School does not and cannot guarantee that you will not injure yourself when playing disc golf, whether or not you employ the techniques and strategies taught in the materials. The techniques and strategies are designed to improve your game and may involve a greater range of motion or different physical movements than that previously used by you in playing the game of disc golf. In some circumstances, use of these techniques and strategies can increase the risk of physical injury because they will be new and may require different movements than what you are used to. Improperly performing the techniques or strategies may also increase your risk of injury. In accessing the materials, you acknowledge that you have considered and are assuming these risks. You further acknowledge that any choice to use the materials and instruction in your own disc golf game is voluntary and is taken by you with knowledge of the dangers involved.

By accessing the materials, you agree to accept and assume all risks of injury, disability, property damage, and/or financial loss arising from your participation in the course and/or use of the materials, including in connection with your own disc golf game, whether caused by the ordinary negligence of the School or its instructor or otherwise. You also expressly waive and release any and all claims, now known or hereafter known, against the School and its instructor arising out of any injury, disability, property damage, and/or financial loss arising from your participation in the course and/or use of the materials, including in connection with your own disc golf game, whether caused by the ordinary negligence of the School or its instructor or otherwise. To the extent any such claim is asserted against the School or its instructor, you agree to defend, indemnify, and hold the School and its instructor harmless against and from such claim.

5. Limitations

In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorized representative of the School has been notified orally or in writing of the possibility of such damage. In the event the School is determined to be liable for any such damages, the maximum amount the School’s liability shall in no event exceed the dollar amount you paid to subscribe to the course and access the materials. 

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you in full but shall apply to the fullest extent permitted by the law of your jurisdiction.

6. Revisions and Errata

The materials appearing on the School’s website may include technical, typographical, or photographic errors. The School does not warrant that any of the materials on its web site are accurate, complete, or current. The School may make changes to the materials contained on its web site at any time without notice. The School does not, however, make any commitment to update the materials.

7. Links

The School has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the School of the site. Use of any such linked website is at the user's own risk.

8. Site Terms of Use Modifications

The School may revise these Terms of Use for its website at any time without notice. By using this website and/or the School materials, you are agreeing to be bound by the then current version of these Terms of Use.

9. Governing Law and Venue

Any claim relating to the School’s website shall be governed by the laws of the School owner’s home jurisdiction without regard to its conflict of law provisions. The School owner’s current home jurisdiction is Texas. To the extent you bring any claim against the School or its owner in any way related to the course or the materials, you agree to bring such claim in the state or federal courts situated in Travis County, Texas and hereby waive your right to bring such claim in any other jurisdiction or venue.

10. Refund Policy; Suspension / Termination of Access

All subscription sales are final, including “pre-sales,” and no course customer has a right to any refund. However, if you have any issues accessing the course materials, you may contact the School owner, and the School will work with you to ensure that you can access the materials you purchased, subject to these Terms of Use. The School does reserve the right to suspend or terminate your access to the materials if you fail to comply with these Terms of Use or otherwise engage in behavior that is abusive or threatening or that may reasonably be considered to interfere with other subscribers’ ability to use the materials as intended. Again, if the School suspends or terminates your access, you will not be entitled to a refund. You are expected to participate in the course subject to these Terms of Use and consistent with the other rules and directions provided by the School from time-to-time.
